A bid to stop the Banbury Gateway retail development was dismissed at the Court of Appeal yesterday.
Cherwell District Council granted permission for the development, north of the M40 junction, in December 2012 but shopping centre owners claimed the decision was legally flawed and would draw trade from the town centre.
A judge refused to grant Scottish Widows Plc, which owns Castle Quay, and Aegon UK Property Fund Limited, which owns Banbury Cross, permission to appeal the decision.
